Anyone With Immigration Law Expertise?
My son is engaged to a woman from Brazil. She is in the US on a work visa doing post-doc research for NIH. They plan to be married in Brazil this fall. She will renew her visa in Brazil before the wedding. They will also get married in the US when they return. When we asked why they were planning this they said that if they were to get married in the US before going to Brazil, then they probably wouldn't renew her visa, figuring she would not return to Brazil. They also say she must return to Brazil for two years after her visa ends unless they apply for and are granted an exception to that requirement. This apparently applies even though she will be married to a US citizen. They consulted an immigration attorney who told them the exception is nearly impossible to get but they know two people who work in her lab who did get it.
This all sounds very odd to me. Anybody have an insight into how this works?
