McCabe declined nonjudicial punishment (Article 15 UCMJ) and demanded a CM. What a waste of DOD $. A SEAL is a valuable commodity and the Navy made a big error by letting this go so far.

McCabe was the third and final Navy SEAL to be prosecuted in the case. He had faced charges of assault, making a false official statement and dereliction of performance of duty for willfully failing to safeguard a detainee. I don't know what the deal is, but there have been a long string of similar instances of unwarranted and/or inept prosecution of naval and Marine personnel since the war started. Maybe it's the Nerds In Suits, or the prosecutors, but it ain't right.
