I'd imagine that the issue of sacredness was raised in the complaint for the sake of drama. I doubt the judge ruled on the specific matter of sacredness. I didn't read the decision, but from the wording of the summary, I guess that the judge ruled on the narrow ground that the complainant had not shown he would be harmed by any non-sacredness, nudity, drunkenness, or drugs at the Halloween festival in Lahaina. So he had no standing to sue.
