Paris Hilton was taken from a courtroom screaming and crying Friday seconds after a judge ordered her returned to jail to serve out her entire 45-day sentence for a parole violation in a reckless driving case.

"It's not right!" shouted the weeping Hilton. "Mom!" she called out to her mother in the audience.

Hilton, who was brought to court in handcuffs in a sheriff's car, came into the courtroom disheveled and weeping. Her hair was askew and she wore a gray fuzzy sweatshirt over slacks. She wore no makeup and she cried throughout the hearing.

Her body also shook constantly as she dabbed at her eyes. Several times she turned to her parents who were seated behind her in the courtroom and mouthed the words, "I love you."

Superior Court Judge Michael T. Sauer was calm but apparently irked by developments of the morning. He said he had left the courthouse Thursday night having signed an order for Hilton to appear for the hearing.
When he got in his car early Friday, he said, he heard a radio report that she would not appear and that he had approved a telephonic hearing. He said no such thing had been approved by him.

"I at no time condoned the actions of the sheriff and at no time told him I approved the actions," he said of the decision to release Hilton from jail after three days.

"At no time did I approve the defendant being released from custody to her home on Kings Road," he said.

The hearing was requested by the city attorney's office, which had prosecuted Hilton and wanted Los Angeles County Sheriff Lee Baca held in contempt for deciding to reassign Hilton to home detention despite the judge's express order that she must serve her time in jail.

A member of the county counsel's staff said that Baca was concerned with Hilton's medical condition and was willing to come to court with medical personnel to meet with the judge. The judge did not take him up on the offer, however the judge took no action on the contempt request.
Assistant City Attorney Dan F. Jeffries argued that Hilton should be returned to jail and said that was purely the judge's decision to make.
He said that "her release after only three days erodes confidence in the judicial system."

Hilton's attorney, Richard Hutton, implored the judge to order a hearing in his chambers at which he would hear testimony about Hilton's medical condition before making a decision.

The judge did not respond to that suggestion.

Another of her attorneys, Steve Levine, said, "The sheriff has determined that because of her medical situation, this (jail) is a dangerous place for her."

"The court's role here is to let the Sheriff's Department run the jail," he said.

A former district attorney, Robert Philibosian, also represented Hilton. He said that the law supports the sheriff in making an independent decision on her custodial situation.

The judge interrupted several times to say that he had received a call last Wednesday from an undersheriff informing him that Hilton had a medical condition and that he would submit papers to the judge to consider. He said the papers never arrived.

Every few minutes, the judge would interrupt proceedings and state the time on the clock and note that the papers still had not arrived.
He also noted that he had heard that a private psychiatrist visited Hilton in jail and he wondered if that person played a role in deciding her medical needs.

The last attorney to speak was another deputy city attorney, David Bozanich, who declared, "This is a simple case. There was a court. The Sheriff's Department chose to violate that order. There is no ambiguity."
As he made the final pitch for Hilton's further incarceration, Hilton's entire body began trembling. He had a ball of tissue clutched in her hand and tears ran down her face.

Seconds later the judge announced his decision.

"The defendant is remanded to county jail to serve the remainder of her 45-day sentence. This order is forthwith," he said.

Hilton screamed.

The courtroom was surrounded with eight deputies who immediately ordered all spectators out.

Hilton's mother Kathy threw her arms around her husband Rick and sobbed uncontrollably.
Deputies escorted Hilton out of the room, holding each of her arms as she looked back.

Wouldn't it be great if she came out of a jail as a born again Christian or a Moslem.

This is the best news I've heard all day!!!

A judge who's holding the accused, the sheriff, and the lawyers all accountable for their actions (or lack thereof)?!? I'd be proud to put my taxpayer dollars to work for his salary!

Hilton's publicist must be getting nominated to the Celebrity Spokesperson Hall of Fame for this gig. No such thing as bad publicity indeed... Britney Spears & Michelle Rodgriguez are green with envy!

Paris Hilton... Poor baby, getting a well deserved timeout at the downtown LA Hilton!

I just cant understand why she didnt have a driver take her around while her license was suspended. Or the night she got caught driving drunk.

As fashionable as it has become to 'hate' Paris Hilton, I disagree with the sentence she received. Ann Coulter , whom I rarely agree with, said the following:
I think the judge has Judge Ito disease, he wanted to get his name in the paper and he succeeded. And everyone around her, everyone involved in this case -0- is not going to have a story to sell to inside edition. I think that No one disputes that anyone else ... a normal citizen wouldn't get 45 days in this case. Even Nicole Richie, who isn't a normal citizen, didn't get a sentence like this."
I agree with her wholeheartedly! Traffic offenses do not merit 45 days in prison. The judge should be investigated.

It was her SECOND DUI, and she was driving at the time with a SUSPENDED license..............:eek:

Sounds pretty illegal to me.............:p

I agree with Sam -- it was more than a traffic violation.

I'll admit that this news made my day, actually I think that's hot, using the words of Ms Hilton.

If she is not fit to serve time in jail, I would be satisifed if she had to serve out the rest of her time picking up litter from the side of the freeway, as long as they alert the media to exactly where she will be so there are plenty of pictures of her picking up trash in a bright orange jumpsuit.

I was in the airport today and I figured that World Peace had broken out since the only thing on CNN for the two hours that I waited for my flight was Paris Hilton and that there must have not been anything else to report.

In another piece on the LA County Jail, it discussed a person who had gotten a 60 day sentence for her second DUI so 45 days did not seem unreasonable.

Wow, you just pull that out of the air? I hope you research your stock picks with more dilligence!!
Anyway, this was her first offense and she had a valid license at the time. Paris Charged With DUI - TMZ.com

Here is a copy of the actual charges if you still doubt. http://cdn.digitalcity.com/tmz_documents/paris_dui_charges.pdf

- note where it says "prior convictions - NONE". ;)

Still, that doesn't make it OK. She should be punished to exactly the same extent that any other person would be. Not more or less severely simply because she is a celebretard.

I'm not a fan of the woman, but... I think her lawyers failed her big time. I do not practice in L.A. County but it is well know in Southern California that a person with a similar record and sentenced to 45 days in county jail would have been booked & released in L. A. County. The Feds are threatening to take over the county jail system if L.A. County does not reduce their overcrowding. But this has been going on since the 90s. The fact is that she is getting special treatment in that she is doing jail time whereas the average person in L.A. County would not. I have heard of people sentenced to 60 days turn themselves in but are basically turned away. Our county has similar problems but not as bad. She definitely is being treated differently then everybody else. A person sentenced to 1 year would only actually serve a couple of months in L.A. County. The sheriff of the county, Lee Baca, said as much in his statement to the press. The amount of tax dollars that is going to be spent to keep that woman locked up, because everybody wants to feel good about locking up a spoiled little rich girl, is going to be horrendous. Besides it is just plain mean spirited. But I am used to being in the minority in a lot of my views. They want to make an example of her because of her celebrity plain and simple.

Maybe for a second DUI 60 days would be appropriate but as I have just proven in the previous post, this was her first offense. Most first offenders pay a fine, have their license suspended, get probation and are forced to attend AA meetings. When there is an accident or injury involved the sentences can be more severe for obvious reasons and obviously the higher the BAC level the more severe the punishment. Paris' BAC was measured at 0.08 - the minimum legal limit where the state deems a person intoxicated and there was no accident or injury.

IMHO, she is in prison because of a judge that is seeking fame. Kind of ironic actually......

So, because there is overcrowding, people are doing much lighter sentences than they've been given and that's OK? Granted there is a media frenzy and schadenfreude over this case, however, it looks as though the communication between the different parts of the system didn't occur and because there is a media frenzy and the microscope, there is going to be a tightening of the enforcement. And Ms Hilton is in the middle of it....however, I don't think that lightening everyone's sentence because there isn't room is a very good solution - perhaps outsourcing to another facility or some other idea is in order. I don't agree with anyone having their sentence reduced by over 90%.

I do admit a bit of satisfaction that she couldn't just buy her way out of this, but frankly, I find her a bore and an egregious example of American culture gone bad....is there anything else on TV:confused:? :) Guess I'll read a book.

Well, the reason that they seem to be throwing the book at her is that she twice violated the terms of her probation by being caught driving with a suspended license. See this article about halfway in the middle.

Deserat as I said people have been turned away from the L.A. County jail since the 90s. AND it will continue. Lee Baca is not going to be putting people in jail when they are given short sentences. There is no room at the Inn. Nobody wants a county jail built in their backyard. Not only is she being made an example by the judge, but that Judge will NOT order the same treatment for everyone else. He can't and there's the rub! He took a very personal dislike of her period. I'll admit she is annoying and it is difficult to avoid hearing about her!(I don't have a TV). But I become annoyed when people are singled out by the system rich or poor or whatever. I think the Judge also thought that it would help him in his next election. (Wow he's the judge who put that rich bitch in jail!!) Most people are a bit too gleeful at her misfortune.

mountaintosea - I still don't agree with their answer to let people out early, whether it is a celebrity or someone else who has a sentence (in fact, don't care who it is if they've been found guilty)- in fact, I like it even less if they've had a DUI because I consider them a danger to the rest of use on the road - they can outsource - I'm sure there might be some room at the prison I live near here in NoCal. I don't like that anyone gets any special treatment, that's my point.

I don't believe the judge sent her to jail because of the DUI. She was sent to jail for refusing to comply with her probation. After giving a convict several chances to comply the judge has no other choice.

im glad shes back in jail, now i can resume my PARIS HILTON ,SEX STARVED WOMEN IN JAIL fantasy and hope for the video ha ha ha

This isn't meant as an attack against anyone here but - I can't believe how much attention this nobody is getting. I can't believe that CNN.com considers this completely insignificant event to be "breaking" news.
