Robocall class action lawsuit - potential $300 per call payout

Here's a chance to get some revenge on one of those pesky robocallers via a class action lawsuit:

A Chicago judge approved a settlement last month that forces Carnival, Norwegian, Royal Caribbean, and a marketing company that worked with them to pay up for spamming people with pre-recorded telemarketing calls that promoted the cruise lines.

If you received one of these calls, you could get up to $300 per call you received (up to $900 per phone number). To find out if you qualify, you can check out the class action’s website and search to see if your phone number qualifies.

I only get robo calls from Marriott. I blacklisted their number.

Nice to know our numbers are not eligible. Wish some of the other spammers would get sued and end up with the same settlements.

ETA: I had to blacklist CVS pharmacy. They would robocall several times a day for prescription renewal reminders. I tried twice to stop the calls by following the on-line process. Did not work.

Keep the money, just stop calling me! I get 10 or 15 calls a day despite blocking every one of them. They just change the incoming number.
Yesterday was a new one: asking me to take part in a breast cancer class action suit.

Since the latter is highly unlikely, I see no reason to not seek compensation from one of the stinkin' robocallers who got caught.

nomorobo.com. Free for landline, $2 a month for mobile. Been using it for 2 years. If it's a robo call, it rings once then disconnects.

My number is not in, but I thought to check my parents' number and it is! I'm going to discuss with my brother, who generally helps them with things like this, and see if they've already filed or if it wants me to do it for them. I'll follow up if I do.

I solved it by having my phone number deleted from the pharmacy's records

Thanks for this. I was getting so many spam calls on our home phone, that I turned off the ringer. Nice to know that we'll be getting some multiple of $300 for our trouble.

Although the headlines say $300, the actual amount could be less - that's the reason for the word "potential" in the thread title. It will depend on how many valid claims are actually filed and approved. From the website FAQ's (my bold):

9. How much will my payment be?

Each RMG telemarketing call you received will have a maximum value of $300. You may file a claim for up to three calls per telephone number included in the Call Records. This means that your maximum payment amount could be $900 per telephone number. Although payment amounts could be $300-$900, actual payment amounts will be based on the total number of calls and valid Claim Forms received. For example:

If, after deducting attorneys’ fees and expenses, the incentive award, and settlement administration costs, the amount needed to pay all valid claims is less than the balance of the Settlement Fund, then each Settlement Class Member who submits a valid Claim Form will receive $300 per call for up to three calls, and the remaining funds will be donated cy pres to the National Consumer Law Center (www.nclc.org) or other approved recipient.

If, after deducting attorneys’ fees and expenses, the incentive award, and settlement administration costs, the amount needed to pay all valid claims is greater than the Settlement Fund Ceiling, then each Settlement Class Member who submits a valid Claim Form will receive a proportionately reduced payment amount, meaning each Settlement Class Member will receive the same reduced payment amount per call for up to three calls.

Suspect that the cash award may go to the lawyers, while claimants are awarded some multiple of robo-calls. You know - twenty of the new improved and approved robo-calls to make up for each defective Carnival robo-call claimed.

I tried that. I went through the on-line process twice to stop them. Did not work either time. Did you deal with the store or the company?

I just checked the blocked call log. 9 calls from CVS on the 14th, 16 calls on the 10th, 9 calls on the 5th, and 6 calls on the 1st. Think I will take my pharmacy business elsewhere.

Looking again at the potential payout, I'm thinking the per call amount will likely be under $300, maybe way under. The attorneys get paid first, plus the expenses. Whatever is left over is divided by the number of valid claims/calls. With a cap of $12.5M I'd guess the attorneys will get about half, leaving roughly $6M for payout. If 500,000 valid claims come in - not unlikely - that would make the payout only $12.

Don't get your hopes up...
