Medicare Part D Donut Hole Agreement

Back in June, there was a much publicized agreement between the President and Big Pharma to halve the amount of time that retirees will spend in the dreaded Donut Hole starting next year.

What I can't find is whether this agreement is contingent upon the current health care legislation passing. Does anybody know?
