I think you’re off the hook. IIRC, most soft serve is not legally ice cream.

Yes, three people died from Listeria in the Tacoma area. Perhaps more will die or be sickened. It can take over two months for the disease to appear after one has been infected. Lawsuits have been filed.

I bet a lot of places that serve similar desserts are beefing up their cleaning practices and thanking the powers-that-be that it was someone else who was the first to get caught being lax about cleaning and food safety.
