opt out bonus for Tricare recipients??

Can someone point me to any law or regulation that prohibits a civilian employer from paying the opt out bonus to employees that have Tricare insurance?

This final rule implements section 1097c of Title 10, United States Code, as added by section 707 of the John Warner National Defense Authorization Act for Fiscal Year 2007, Public Law 109-364. This law prohibits employers from offering incentives to TRICARE-eligible employees to not enroll or to terminate enrollment in an employer-offered Group Health Plan (GHP) that is or would be primary to TRICARE.

Yes, thank you. Exactly what I was looking for!

I just noticed that for nearly a year now I have been receiving the opt out benefit, despite HR knowing that I have TRICARE coverage......am I confused or are they? I'll post an update after speaking with HR next week.
