When and How to Sue?

I know how Vito Corleone would fix the situation, an " Out of Court Settlement process " ;)

On the original scenario , checking out a used car worth $25,000 involves a competent repair shop inspection , up on the lift. A carfax is not acceptable as "checking it out".

No atty will touch anything like this. A $25k case, unless it's a slam dunk, with $ to attach at the loosing end.
 
And some jurisdictions require some sort of "alternative dispute resolution" which *can* be successful. Also agreeing to doing ADR doesn't necessarily mean "done and done"...it often is unsuccessful. I am a registered neutral (general mediator) and have seen/participated in quite a few ADR sessions and I would say that about 60% of them were successful, the other 40% went back to the court.


Who pays for the ADR? Or is it part of the small claims court fee?


The problem I have it that going to arbitration will cost money... more than the fee for small claims... now I could be wrong as I was reading on a website but it seems you have to pay for everything and everybody's time...
