Consider a 2019 retiree.

2018 joint AGI: 187,000.
2019 joint AGI: 144,000.
2020 and future joint AGI: <100,000.

You see where this is headed. When he learned about the stimulus program he hurried to send in his 2019 tax return. Too late. He and his wife received a little less than 700. There are many boomers retiring these days. There must be many others with a similar story. Any hope for a "correction"?
 
Yup, they'll get another $1,700 of stimulus when they file their 2020 tax return.... so $2,400 in total.
 
I still haven't gotten my stimulus check. When I check the status it says that I qualify and it will be deposited to my checking account but there has been no date to be paid yet. It has said this since April 18th with no further updates. Am I in a small group still waiting? My brother who is disabled on SSDI hasn't been paid yet either and I don't think there's a way to check his status. He hasn't needed to file tax returns for quite a few years since the SSDI is his only income.

I just filed it last week, and I see from my online account that it has been received and processed. Will I still be able to get a stimulus check? I can't find anywhere that states anything on this. Interesting, the IRS site does not recognize my Social Security number. I wonder if someone (a scammer, that is) filed my tax return for me?

Update: DW and I got our stimulus payment in the mail last week. So apparently the IRS hasn't connected my Social Security number (and wife's) with someone else -- the website is just a little glitchy. Who could imagine such a thing? :cool:

The experience reminds me of the early days of the ACA rollout -- only I was much more motivated to get in line for that benefit (and more frustrated by the roadblocks) because it amounted to serious money. In the end it worked out, just like this.

FWIW, I found that my VPN was causing problems with the SS site. Once I turned it off, everything went well.

I am 99.9% sure there is a way to do/file something (an appeal?) to have your situation revisited based on your recent 2019 tax return/income. I remember reading something about it on this thread or somewhere else. Unfortunately I can't point you to it.

I don't know anything about the appeal process a PP mentioned.

If your situation is similar in 2020, you can collect the tax credit when you file next spring. It'll be an extra line somewhere on the second page of the 1040, and I'm sure the instructions will be well publicized.
 
I dont owe tax, so I dont need a tax credit. Hoping it works out for a check this year.

It's a refundable tax credit, so you will get it as a refund even if you don't owe any tax at all next year. Unfortunately, I have not heard or seen anything about getting the $1200 out to more people this year. There are still many millions of checks in the queue to be processed, and I can't see the IRS adding more people to the list without explicit direction from Congress.

There is a lot of talk about more stimulus payments in bills that are working their way through Congress now; so there's some hope that the next round would use your 2019 return if it were filed in between the last eligibility determination and the next one. We'll just have to wait and see what passes and what rules are attached to it.

All I see is the FAQ, which says it "should" be returned, which sounds like a recommendation. But nothing that unambiguously states it is required by law, including consequences for not returning. Until I see something more than a weakly worded FAQ, I'm advising DMIL to keep the money she received for her deceased husband.

I didn't expect it, thought my AGI for TY2018 was too high.

But apparently TY2019 counts as well?

All I see is the FAQ, which says it "should" be returned, which sounds like a recommendation. But nothing that unambiguously states it is required by law, including consequences for not returning. I haven't seen anything. Obviously, they knew this was going to happen, but were in a hurry to get the checks out. I plan on keeping my dads check until they show up at the door. Actually, I already gave it away.

It will be interesting to see what happens if there is a new round of stimulus.

Once word gets out that there is no legal requirement and no consequences, all the people who voluntarily returned the money are going to want it back. Good luck with that.

I agree it makes more sense to hold the money and see how this plays out, including possible clarification in subsequent stimulus bills.

Right now, I don't think the IRS has the legal authority under the CARES act to require that taxpayers return the money. There is no clawback of any kind. This explains the weak wording in the FAQ, like "should" rather than must. That may change with subsequent legislation, but I doubt it.

So for now, we're holding on to it.

Yes, if your 2019 tax return was filed and processed by around mid-March, then they used that.

To my great surprise, I just got a check for $1,200. I had filed my 2019 federal income tax return on March 18th and it showed my income way too high to get any money. My 2018 income was lower, low enough to get a check. I expected to get the money as a tax credit on my 2020 return, whose income will also be low enough. Somehow, they must have gone back and used my 2018 income and cut me the check anyway. :dance:
